License Agreement and Limited Warranty

This is an agreement between you, the end user, and BALARAD, s.r.o.. By installing and/or using this Software, you are agreeing to become bound by the terms of this agreement.

If you do not agree to the terms of this agreement, do not use this Software. Promptly remove it from your computer.

This Software is protected by copyright laws and international treaties and may only be used in accordance with the license terms.

BETA VERSION. This paragraph relates to beta version of Software only. By its very nature, beta Software may contain bugs and have errors or incomplete features that may have a detrimental effect on the Software program itself, upon the files on your computer and/or upon your computer. By downloading this Software, you are assuming the risk of any bugs, errors or other effects of the Software on your computer and/or files. Do not rely upon this beta program exclusively for any reason.

INSTALLATION. Do not install or use the Software until you have read and accepted all of the warnings and license terms. Permission to use the Software is conditional upon you agreeing to the license terms. Installation or use of the Software by you will be deemed to be acceptance of the license terms. Acceptance will bind you to the license terms in a legally enforceable contract with Balarad. The installation of this program will install files necessary to operate the program onto your computer. Other system files, such as .DLLs may be installed or updated and Windows registry entries will be made. Uninstalling the program will not remove all of the installed files or registry entries. As with all installations, it is recommended that you back up your hard drive before you install this program. Program installed on computer with Internet connection will regularly download from Balarad server the list of illegal passwords. Copies that use illegal passwords will be switched to unregistered mode. It will be not possible to disable downloading of illegal passwords. During this operation program will not send any information out of the user's computer.

GRANT OF LICENSE. Balarad grants to you a non-exclusive right to use the Software during the term of the test evaluation period in accordance with the terms contained in this license. You agree to allow this Software to store small amounts of information necessary to protect the Software against unauthorized use, and you acknowledge that Balarad will not disclose any information related to removing or overcoming such anti-piracy information stored in your system at any time.

OWNERSHIP OF SOFTWARE. Balarad and its suppliers retain the copyright, title and ownership of the Software and the written materials.

TERM. This License commences upon the installation of the Software and is effective until terminated by Balarad. Balarad may terminate this License for any reason or for no reason. Balarad may have included code in the Software that will cause the Software to terminate automatically after a certain date or after a certain number of uses. Such termination may occur without notice to you. Upon termination you shall remove the Software from your computer(s).

PERMITTED USES. You may use this Software on a single computer, but may transfer it to another computer as long as the other computer is owned by you and as long as it is used on only one computer at a time.

NON-PERMITTED USES. You may not lend, lease, rent, sub-license or otherwise distribute any portion of this Software. You may not translate, reverse program, disassemble or decompile this Software.

FREE DESIGNS INCLUDED IN SOFTWARE. Free designs included in Software are intended for testing Software features, either in registered or in demo mode of Software. Free designs included in Software may not be sold, given, lend or otherwise disseminated without permission of Balarad. Registered users of Software may sell garments embroidered with Free designs included in Software. Any use of Free designs included in Software other than specified above must be licensed by Balarad.

THIRD PARTIES. Any user of this Software should adhere to applicable license agreements of all third parties. This product is not intended to be used to violate copyright laws, trademarks or other rights of third parties.

LIMITED WARRANTY. This Software and accompanying documentation (including instructions for use) are provided "as is" without warranty of any kind, further, Balarad does not warrant, guarantee, or make any representations regarding the use, or the results of use, of the Software or documentation in terms of correctness, accuracy, reliability, currentness, or otherwise. The entire risk as to the results and performance of the Software is assumed by you. If the Software or written materials are defective, you, and not Balarad or its dealers, distributors, agents, or employess, assume the entire cost of all necessary servicing, repair or correction. To the maximum extent permitted by law, Balarad provides this Software without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and noninfringement. No oral or written information or advice given by Balarad, its dealers, distributors, agents or employees shall create a warranty or in any way increase the scope of this warranty and you may not rely on any such information or advice. You may have other rights which vary from state to state. Neither Balarad nor anyone else who has been involved in the creation, production or delivery of this product shall be liable for any direct, indirect, consequential of incidental damages (including damages for loss of business profits, business interruption, loss of business information, and the like) arising out of the use or inability to use such product even if Balarad has been advised of the possibility of such damages. Balarad does not guarantee correct processing of any TrueType or OpenType font in Embird Font Engine plug-in. TrueType and OpenType fonts are not originally designed for conversion into embroidery designs, therefore the quality of conversion may vary from character to character even within the same font. The inability of Font Engine to create embroidery design from any font or character is not considered as a reason for money refund. In no event will Balarad's liability for any damages to you or any other person exceed the amount paid for the license to use the Software.

Diese Vereinbarung wird zwischen Ihnen als Benutzer der Software und der Firma BALARAD, s.r.o. geschlossen. Durch Installation und/oder Benutzung der Software stimmen Sie den Bedingungen zu und verpflichten sich, diese zu befolgen.

Wenn Sie mit den Bedingungen dieser Vereinbarung nicht einverstanden sind, benutzen Sie die Software nicht. Enfernen Sie sie von Ihrem Computer.

Diese Software ist durch Urheberschutzgesetze und internationale Abkommen geschützt und darf nur gemäß den Lizensbedingungen verwendet werden.

Während der Installation dieses Programms werden Dateien installiert, die zur Funktion des Programms auf Ihrem Computer nötig sind. Andere Systemdateien, wie .DLLs, können installiert oder aktualisiert und Einträge in die Registrierdatenbank gemacht werden. Die Deinstallation des Programms entfernt nicht alle installierten Dateien oder Registrierdatenbank-Einträge. Wie bei allen Installationen ist es empfehlenswert, eine Festplattensicherung vorzunehmen, bevor sie das Programm installieren.

LIZENS. Balarad gewährt Ihnen während der Testzeit ein nicht-exclusives Recht, die Software zu benutzen, entsprechend den Bedingungen dieser Lizens. Sie gestatten der Software, kleine Mengen Information zu speichern, um die Software gegen unerlaubte Benutzung zu sichern. Außerdem nehmen Sie zur Kenntnis, daß Balarad keine Informationen freigibt, die in irgendeiner Form mit der Entfernung oder dem Versuch der Überwindung dieser Anti-Software-Piraterie-Informationen in Ihrem Computer zu tun haben.

BESITZRECHT DER SOFTWARE. Balarad und die lizensierten Händler dieser Firma halten das Urheberrrecht, den Titel und das Eigentumsrecht an dieser Software und allen schriftlichen Materialien, die zu dieser Software gehören.

DAUER. Diese Lizens wird mit Installation der Software erteilt und hat solange Bestand, bis die Firma Balarad sie beendet. Die Firma Balarad kann diese Lizens zu jeder Zeit und aus jedem Grund beenden. Die Firma Balarad kann einen Code in die Software einbauen, der dazu führt, daß die Software nach einem bestimmten Datum oder einer bestimmten Anzahl von Nutzungen die Funktion einstellt. Solch eine Beendigung der Funktion kann ohne vorherige Warnung eintreten. Nach dieser Beendigung der Funktion der Software entfernen Sie diese bitte von Ihrem/n Computer/n.

ERLAUBTE VERWENDUNG. Sie dürfen diese Software auf einem Computer benutzen und Sie dürfen diese Software auf einen anderen Computer übertragen, solange dieser zweite Computer Ihnen gehört und Sie die Software nur auf einem Computer zur Zeit installiert haben.

NICHT GESTATTETE VERWENDUNG. Sie dürfen die Software nicht verleihen, vermieten, verleasen, Unterlizensen vergeben oder in irgendeiner Form Teile dieser Software weitergeben. Sie dürfen diese Software nicht übersetzen, rückwärts programmieren, auseinandernehmen oder zerteilen.

DIE RECHTE DRITTER. Jeder Benutzer dieser Software muß sich an die Lizensvereinbarungen mit Dritten halten. Dieses Produkt ist nicht dazu gedacht, Copyrightgesetze zu brechen, Warenzeichen oder andere Rechte Dritter zu verletzen.

HAFTUNGSAUSSCHLUSS. Diese Software und begleitende Schriften oder Instruktionen (auch Handbücher usw.) werden ohne Anspruch auf Haftung zur Verfügung gestellt. Außerdem übernimmt Balarad keine Verantwortung, gibt keine Garantie oder übernimmt sonstige Verpflichtungen, die die Nutzung der Software betreffen oder das Ergebnis der Nutzung der Software  Der Nutzer trägt das Risiko der Nutzung und daraus resultierender Ergebnisse dieser Software. Sollte die Software oder dazugehörige Drucksachen fehlerhaft sein, tragen Sie die Kosten der nötigen Reparatur oder des Ersatzes, nicht die für Balarad tätigen Händler, Agenten oder Mitarbeiter. Balarad stellt diese Software ohne jedwede Haftungsgarantie zur Verfügung, weder ausdrücklich noch angenommen, dies beinhaltet u.a. auch die Garantie der Verkäuflichkeit der Software, der Funktion für bestimmte Zwecke. Keinerlei mündliche oder schriftliche Information oder Ratschläge durch die Firma Balarad, ihre Händler oder Mitarbeiter kann eine Garantie darstellen oder den Umfang einer Garantie vergrößern und Sie dürfen sich nicht auf solche Informationen oder Ratschläge verlassen. Die Rechtslage kann von Land zu Land verschieden sein. Weder die Firma Balarad noch irgendjemand anders, der in die Programmierung, Erstellung, Produktion oder Auslieferung dieser Software eingebunden ist kann haftbar gemacht werden für irgendwelche direkten oder indirekten Schäden (das beinhaltet auch Schäden durch entgangenen Umsatz oder Gewinn, Unterbrechung der Produktion, Verlust von Geschäftsinformationen usw.), die aus der Benutzung oder etwaigen Fehlern der Software resultieren, auch wenn Balarad über die Möglichkeit dieser Fehler oder Schäden informiert wurde. Balard garantiert nicht die korrekte Bearbeitung und Programmierung von TrueType oder OpenType Fonts im Embird Font Engine Plug-In Programm. TrueType und OpenType Fonts sind nicht ursprünglich zur Umwandlung in Stickmuster konzipiert, somit kann die Qualität der Umwandlung von Buchstabe zu Buchstabe variieren, sogar innerhalb einer Schrift. Die mögliche Unfähigkeit der Software, Stickmuster von  irgendwelchen Fonts oder Buchstaben zu erzeugen ist kein Grund für eine Rückerstattung des Kaufpreises. Unter keinen Umständen wird die Haftung der Firma Balarad für irgendwelche Schäden, die Ihnen oder irgendwelchen anderen Personen entstanden sind, den Kaufpreis der Nutzungslizens der Software überschreiten.

INSTALLATION. N'installez pas le logiciel avant d'avoir lu et accepté toutes les mises en gardes et les termes de la licence. La permission d'utiliser ce logiciel est assujettie a votre acceptation des termes de la licence. L'installation ou l'utilisation du logiciel sera considéré comme une acceptation des termes de la licence. L'acceptation vous liera aux termes de la licence par un contrat légalement applicable avec BALARAD. L'installation de ce programme placera les fichiers nécessaires au fonctionnement du logiciel sur votre ordinateur. Les autres fichiers systeme comme les DLL pourront etre installés ou mis a jour et les entrées de la base de registre seront créées. La désinstallation du logiciel n'enlevera pas tous les fichiers ou toutes les entrées de la base de registre. Comme avec toutes les installations, il est recommandé de faire une sauvegarde de votre disque dur avant d'installer le programme.

ACCORD DE LICENCE. Balarad vous accorde un droit non exclusif d'utilisation du logiciel pendant la duré de la période d'évaluation en accord avec les termes contenus dans cette licence. Vous acceptez de permettre a ce logiciel d'enregistrer une petite quantité d'informations nécessaire pour protéger le logiciel contre une utilisation non autorisée et vous prenez note que Balarad ne divulguera a aucun moment des informations relatives au retrait ou mise en place tel que les informations anti-piratage enregistrées dans votre systeme.

PROPRIETE DU LOGICIEL. Balarad et ses distributeurs conservent les droits de copie, le titre et la propriété du logiciel ainsi que les textes écrits.

TERMES. Cette licence débute avec l'installation du logiciel et est effective jusqu'a la résiliation par Balarad. Balarad pourra mettre fin a cette licence pour n' importe quelle raison ou sans raisons. Ballarad a inclus un code dans le logiciel qui l'arretera automatiquement apres une certaine date ou un certain nombre d'utilisations. Cet arret se produira sans avertissement. A la suite de cet arret vous devrez retirer le logiciel de votre ordinateur.

Ce logiciel et sa documentation d'accompagnement (incluant les instructions d'utilisation) sont fourni "tel quel" sans garantie d'aucune sorte, en conséquence, Ballarad ne garantie pas, ne peut se porter garant, quant a l'utilisation, ou les résultats d'utilisation, du Logiciel ou de la documentation en termes de justesse, d'exactitude, de fiabilité, de précision, ou autre. Tous les risques quant aux résultats et aux performances du Logiciel sont assumés par vous. Balarad ne garantit pas le traitement correct d'aucune police de caractere TrueType ou OpenType dans le module d'extension Font Engine. Les polices de caractere TrueType et OpenType ne sont pas a l'origine conçu pour la conversion en motifs de broderie, donc la qualité de conversion peut varier d'un caractere a un autre meme au sein une police de caractere. L'inaptitude de Font Engine a créer des motifs de broderie a partir de n'importe quelle police de caractere n'est pas considérée comme un motif de remboursement. En aucun cas la responsabilité de Balarad pour n'importe quels dommages survenu a vous ou une autre personne n'excedera la somme payée pour la licence d'utilisation du Logiciel.

CONTRATTO DI LICENZA D’USO E GARANZIA LIMITATA

Il presente documento costituisce un contratto tra Voi, l’utente finale e la BALARAD s.r.o.

L’installazione e/o l’utilizzo del Software implica l’accettazione integrale del presente contratto

SE RITENETE DI NON ACCETTARE I TERMINI DEL PRESENTE CONTRATTO, NON UTILIZZATE IL PROGRAMMA E DISINSTALLATELO DAL VOSTRO COMPUTER.

Il presente Software è protetto dalle leggi sul diritto d’autore e dai trattati internazionali e può essere utilizzato solo second quanto stabilito dal presente contratto di licenza d’uso.

VERSIONE BETA. Il presente paragrafo si riferisce esclusivamente alla versione Beta del software. A causa delle sue caratteristiche intrinseche, il Software Beta può contenere errori o funzioni incomplete che possono ripercuotersi sul funzionamento del Software, sui files presenti sul Vostro computer e/o sul Vostro computer. Se scaricate questo Software, Vi assumete il rischio di ogni malfunzionamento, errore, o qualsiasi altra conseguenza che il Software può causare ai Vostri files o al Vostro computer.

Non installate o utilizzare il Software sino a quando non avete letto e accettato tutte le avvertenze e tutti i termini del contratto di licenza. L’autorizzazione ad utilizzare il Software è condizionata all’accettazione dei termini del contratto di licenza. L’installazione o l’utilizzo del Software verrà considerato quale accettazione dei termini del contratto di licenza. Tale accettazione costituisce impegno al rispetto dei termini della licenza in un contratto giuridicamente vincolante con la BALARAD s.r.o.

L’installazione di questo programma installerà sul Vostro computer i files necessari al funzionamento del programma stesso. Altri file di sistema, quali per esempio librerie DLL, potranno essere installati o aggiornati, e verranno effettuate delle modifiche e delle aggiunte al registro di sistema di Windows. Così come per ogni installazione, si raccomanda di effettuare un back up del disco rigido prima di procedere all’installazione di questo programma.

Il programma installato su computer dotati di connessione Internet provvederà periodicamente a scaricare dal sito della BALARAD s.r.o. una lista delle password non autorizzate. Le copie del programma che utilizzano password non autorizzate vengono automaticamente riportate alla versione non registrata Non è possibile disattivare l’aggiornamento delle pessword non autorizzate. Nel corso di questa operazione non viene inviata dal computer dell’utente nessuna informazione.

GARANZIE DELLA LICENZA. La BALARAD s.r.l. Vi garantisce un diritto non esclusivo all’utilizzo del Programma nel corso del periodo di prova secondo quanto stabilito dal presente contratto di licenza. (Con l’accettazione di questo contratto di licenza) Vi impegnate a consentire al Programma di memorizzare alcune informazioni necessarie alla protezione del Programma contro il suo utilizzo non auorizzato, e siete consapevoli che la BALARAD s.r.o. non fornirà in nessuna occasione alcun tipo di informazione circa la rimozione o il funzionamento di tali informazioni anti pirateria che vengono memorizzate sul Vostro computer.

PROPRIETA’ DEL PROGRAMMA. La BALARAD s.r.o e i suoi fornitori sono i soli ed unici titolari del diritto d’autore nonchè della proprietà e della paternità del Programma e di ogni documentazione scritta.

TERMINI. Il contratto di licenza ha inizio al momento dell’installazione del Programma e mantiene la sua efficacia sino a quando non venga cessato dalla BALARAD s.r.o. La BALARAD s.r.o. può cessare questo contratto di licenza per un qualsivoglia motivo o anche senza motivo alcuno. La BALARAD s.r.o. può aver incluso nel Programma un codice che prevede la disattivazione automatica del Programma stesso trascorso un determinato periodo o dopo un determinato numero di utilizzi. Tale disattivazione può avvenire senza preavviso. Dopo la disattivazione dovrete rimuovere il Programma dal Vostro o dai Vostri computer.

UTILIZZI CONSENTITI. Potete utilizzare questo Programma su un solo computer. È comunque consentito installare in Programma anche su un altro computer, a condizione che entrambi i computer siano di Vostra proprietà e che il Programma venga utilizzato su un solo computer per volta.

UTILIZZI NON CONSENTITI. È vietato prestare, cedere in leasing, noleggiare, sub licenziare o comunque distribuire in qualsiasi forma una qualsivoglia parte del Programma. Non è altresì consentito tradurre, disassemblare, decompilare o comunque scomporre il Programma.

DISEGNI GRATUITI COMPRESI NEL PROGRAMMA. I disegni gratuiti compresi nel Programma hanno il solo scopo di testare le caratteristiche del Programma, sia nella versione demo che in quella registrata. I disegni gratuiti compresi nel Programma non possono essere venduti, prestati, condivisi, o comunque distribuiti senza il permesso esplicito della BALARAD s.r.o. Gli utenti registrati del Programma possono vendere articoli che siano stati ricamati utilizzando i disegni gratuiti inclusi nel Programma. Qualsiasi utilizzo dei disegni gratuiti inclusi nel Programma diverso da quelli appena menzionati deve essere esplicitamente autorizzato dalla BALARAD s.r.o.

DIRITTI DEI TERZI. Chiunque utilizzi questo Programma si impegna a rispettare gli eventuali contratti di licenza applicabili di terzi. Il presente programma non può essere utilizzato per violare le norme sul diritto d’autore, i marchi registrati, o qualsiasi altro diritto di terzi.

QUESTO PROGRAMMA E LA DOCUMENTAZIONE CHE LO ACCOMPAGNA (COMPRESE LE ISTRUZIONI PER L’UTILIZZO) SONO FORNITE ‘COSI’ COME SONO” SENZA GARANZIA ALCUNA DI ALCUN GENERE. LA BALARAD s.r.o. NON FORNISCE ALCUNA GARANZIA NE’ IMPLICITA NE’ ESPLICITA, IN MERITO ALL’UTILIZZO, O AI RISULTATI CONSEGUENTI ALL’UTILIZZO, DEL PROGRAMMA E DELLA DOCUMENTAZIONE, IN RELAZIONE ALLA LORO CORRETTEZZA, ACCURATEZZA, AFFIDABILITA’, AGGIORNAMENTO, O QUANT’ALTRO. TUTTI I RISCHI RELATIVI AI RISULTATI E AL FUNZIONAMENTO DEL PROGRAMMA GRAVANO INTERAMENTE SULL’UTENTE. SE IL PROGRAMMA O LA DOCUMENTAZIONE SCRITTA DOVESSERO ESSERE IN QUALSIASI MODO DIFETTOSI, L’INTERO COSTO DI OGNI INTERVENTO, RIPARAZIONE O CORREZIONE, GRAVERA’ INTERAMENTE SULL’UTENTE E NON SULLA BALARAD s.r.o.
